Fundamentals of Labour Law

Course Purposes

Labour Law aims to counteract the inequality of power between employers and employees. This course is aimed at ensuring that students are well equipped with a thorough knowledge of the principles of Labour Law as well as an ability to apply the law in practice.

Course Objectives:

By the end of this course each attendee will be able to
  • Critically examine the context of Australian employment laws and the rights and obligations that arise in employment relationships
  • Critically appraise the principles, statutory frameworks, and institutions regulating labour relations in local and international contexts
  • Apply principles and rules governing the employment relationship to real world problems and devise solutions
  • Apply theoretical and practical skills in the practice of conciliation and arbitration
  • Outline dispute resolution processes appropriate to culturally diverse environments
  • Hypothesise the future direction of labour law and relevant dispute resolution processes and formulate ideas for law reform

  •  Unfair Labour Practice, Prohibition of Unfair Discrimination and Affirmative Action
  •  Discipline and Dismissal
  •  Collective Labour Law: Freedom of association, organizational rights, collective bargaining, workplace forums, strikes/lock-outs, pickets and protect action
